Logos, or other images, on this Site or Apps, including but not limited to the Ohio Liquor and Ohio Liquor Logo, are protected as registered or unregistered Trademarks, trade names and/or service marks owned by JOBS. Except as otherwise agreed in writing with JOBS, you may not use any of the Trademarks displayed on this Site, the Apps or in any Site or Apps content except as provided in these Terms. Any other use is strictly prohibited, and all rights are reserved. JOBS respects the intellectual property rights of others and asks users of this Site and its related services, including any communications to do the same.


6. Use License.

Permission is granted to temporarily access the software on the Site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you will not:

  1. copy any software or technical information;
  2. attempt to decompile or reverse engineer any software contained on the Site;
  3. violate or remove any copyright or other proprietary notations from any materials; or

  2. Your wireless carrier's standard message and data rates apply to all SMS communications;
  3. Message delivery cannot be guaranteed and may be delayed or affected by factors outside of our control; and
  4. We are not liable for any loss or damage arising from your failure to receive messages or any delay in their receipt.


11. Links.

The Site and its related services have not reviewed all the Site’s links and is not responsible for the contents of any such linked site. The inclusion of any link is not an endorsement by the Site and its related services, including any communications. Use of any such linked website is at the user's own risk.


12. Investigations.

JOBS reserves the right to investigate suspected violations of these Terms. If JOBS believes, in its sole discretion, that a violation of these Terms has occurred, it may edit, modify, remove material permanently, or warn users. JOBS will fully cooperate with any law enforcement authorities or court order requesting or directing JOBS to disclose the identity of anyone posting any e-mails, or publishing or otherwise making available any materials that are believed to violate these Terms. BY ACCEPTING THIS AGREEMENT, YOU WAIVE AND HOLD HARMLESS JOBS AND ANY JOBS EMPLOYEE FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY JOBS DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER JOBS OR LAW ENFORCEMENT AUTHORITIES.


13. Entire Agreement.

Except to the extent otherwise set forth in the Terms, these Terms set forth the entire understanding with respect to your access to and use of the Site and its related services, including any communications and the Content, and it supersedes all prior or contemporaneous understandings regarding access and use.


14. Reservation of Rights.

JOBS reserves the right to modify or discontinue, temporarily or permanently, all or any part of the Site, and its related services, including any communications, any software and/or facilities with or without notice, and/or to establish general guidelines and limitations on their use.


15. Severability.

If any provision of these Terms is or shall be found to be unlawful, it shall not affect the validity and enforceability of any remaining provisions in this agreement.


16. Waiver.

Failure by JOBS, in any instance, to exercise any of its rights under the Terms will not constitute waiver of such right or any other rights under the Terms.


17. Governing Law.

These Terms shall be governed by, construed, and enforced in accordance with the laws of the State of Ohio, without regard to conflict of law. You consent to the exclusive and personal jurisdiction in and venue in the state and federal courts in Franklin County, Ohio, USA.


18. Accuracy of Materials and Communications.

The materials appearing on the Site and its related services, including any communications could include technical, typographical, or photographic errors. JOBS does not warrant that any of the materials or communications are accurate, complete, or current. JOBS may make changes to the materials contained on the Site and its related services, including any communication protocols at any time without notice.
